TOPIC: What to do when a POA Agent or Guardian Abuses Their Powers
SPEAKERS: Attorneys Sarah M. LeRose and Leonard J LeRose, Jr.
DESCRIPTION: Attendees will learn various actions to take when an Agent under a Power of Attorney document or a Guardian abuses their powers, including how to remove the Agent or Guardian from their position of power. Attendees will also learn the basics of the Power of Attorney Act, the importance of filing for guardianship, issuing Citations to Discover, and pursuing Accounting Actions through the guardianship Court.
Speaker Bios:
Leonard J. LeRose, Jr. is the founder and owner of Leonard J. LeRose, Jr., Ltd. and has practiced law in the Chicagoland area for over 35 years. Len concentrates his practice in contested and non-contested decedent's estates, guardianships, and minor's estates, and has been involved in numerous Probate and Chancery proceedings involving will contests, trust contests, discovery and recovery citations, accounting actions, actions involving Powers of Attorney, capacity hearings and removal hearings. Throughout his career, Len has received several hundred court appointments as Guardian ad Litem and Special Administrator, to address probate issues in contested and non-contested cases in the Probate Division, Law Division, and Divorce Division in the Circuit Court of Cook County. He has also been involved in litigating cases of first impression, in both the trial court and appellate court. Len received his Juris Doctorate from the John Marshall Law School and received his Bachelor’s degree from the University of Notre Dame.
Sarah M. LeRose is an Associate Attorney at Leonard J. LeRose, Jr., Ltd., focusing her practice in the areas of estate litigation, estate administration and contested guardianship matters (for adults and minors). Sarah is frequently appointed by judges in the Probate Division of the Circuit Court of Cook County to serve as Guardian ad Litem and as attorney for alleged disabled adults. Sarah represents individuals, fiduciaries, guardianship agencies and financial institutions in all areas of her practice. Sarah previously served on the Board of Governors for the ISBA (2017-2020), as one of the Cook County, under the age of 37 representatives and is also a member of the Justinian Society of Lawyers and Chicago Bar Association. Sarah received her Bachelor’s degree from Southern Methodist University and her law degree from Saint Louis University School of Law, where she graduated with Concentrations in Civil Litigation Skills and Criminal Litigation Skills.
